This Privacy Policy applies to the mobile application, “FingerCam” (“Mobile Application“)

SK Code & Design (“Company“, “Us“, “Our“, “We“) would like you to know the privacy practices of Mobile Application. It is very important for the user (“You“) to understand the privacy practice of Mobile Application. If you have any question, please contact the company (Please refer to the “How to contact Us” section below).

We reserve the right to modify this Privacy Policy. We may update this Privacy Policy to reflect changes to our information practices of Mobile Application. This policy addresses the privacy and security of information obtained when you have a relationship with Company as a user of the Mobile Application. Please refer to section “Information collected by Company and Purpose / Use of Information” for details.

This Privacy Policy describes the personal information that we collect from You through the Mobile Application and by continuing to use Mobile Application, you are accepting the practices described in this Privacy Policy. Please review this Privacy Policy periodically as we may amend the privacy policy from time to time.

2. About Mobile Application

Mobile Application is a application that runs on specific mobile devices from Apple Inc. that are equipped with a front facing camera, iPhones, iPod Touch 5th Generation, iPads and iPad mini and iPod Touch 5th Generation (iPhone, iPod Touch, iPod, iPad and iPad mini are registered trademarks of Apple Inc). The primary function of Mobile Application is to automatically capture video recording or image (in the form of a photograph) using three possible options as trigger mechanisms. The first trigger mechanism is a time delay before video or image is acquired. The second trigger mechanism is the human head is detected and remains sufficiently still. The third and last trigger mechanism is when the human head is sufficiently close to the mobile device from Apple. All these trigger mechanism can only function when there is sufficient illumination from natural and/or man-made light sources. The level of illumination required is determined by the make and model of the mobile device from Apple Inc. Without sufficient illumination, the Mobile Application will not function as stated. In addition, due to the lack of actual distance measuring instrumentation and sensors on the model devices from Apple Inc, the Mobile Application can only make a guess of the distance between the subject and the mobile device (from Apple Inc.).

3. Personal information

Personal information means information that can lead to unique identification of an individual such as age, gender, email addresses and date of birth.

4. Information Managed by Mobile Application and Not Collected by Company

Company describes the list of main data categories that are user generated and managed by Mobile Application. Please refer to Data Practices Policy at web site URL “http://www.proximitycam.com/privacy/FingerCamDataPractice/”.

5. Information collected by Company and Purpose / Use of Information

Likely situations that Your personal information may be made available to Company include, but are not limited to: (i) use of the “Feedback”, “How are we doing”, or equivalent to communicate with Us, (ii) correspondence through electronic mail and/or regular mail with the Company, (iii) requesting technical support either through email, telephone or written communications, (iv) “crash reports” that are generated by the mobile operating system may unintentionally contain Personal information or fractions of personal information such as in the stack dump, (v) purchase, billing and market operations, (vi) Our servers automatically record information (“Log Data”) created by Your use of the Mobile Application that may access web content from servers hosted by Us or through appointed service providers. Log Data may include information such as Your IP address, browser type, operating system, the referring web page, pages visited, device type and cookie information.

We uses Log Data from Our servers of web content for service improvements, i.e. to measure, customize, and improve the user experience.

The user experience is very important to the Company and We use aggregated product usage information in order to support product improvement efforts. The aggregated information consists of: product launch and number of application sessions; application commands and operations used; as well as general device information such as iOS version and device type. We use the Flurry Analytics software agent, which collects information and then presents the data to Company in aggregated form. The Flurry Analytics software agent collects the following data: agent version, platform, SDK version, timestamp, API key (identifier for application), application version, device identifier, e.g., UDID, Model (non-iOS), manufacture (non-iOS) and OS version of device (non-iOS), session start/stop time, locale (specific location where a given language is spoken), time zone, and network status (WiFi, etc.). The device identifier is hashed to a Flurry ID. Note that Flurry will see Internet Protocol (IP) address through the HTTP request to send information. For clarity, Company does not receive geo-location data (i.e. GPS coordinates). Aggregated data is considered non-personal information for the purposes of this Privacy Policy.

If you would like to opt-out so that data is not sent to Flurry and then aggregated for Company, You may switch the “Share Performance Data” option to “Off” or the equivalent of “disable” to prevent data being sent to Flurry. In addition, We highly recommend that you terminate the active Mobile Application and restart the Mobile Application. You may also opt-out of all analytics collection by Flurry across ALL applications on your device (including other applications) as explained in the Flurry privacy policy, located at http://www.flurry.com/privacy-policy.html

6. Unknowingly Collect Information from Children under 13 years of age

Mobile Application is not directed to persons under 13 years of age and we do not knowingly contact or collect any personal information from children under 13 years of age. If We learn that we had unknowingly collected or received information from children under 13 years of age, We would take reasonable measures to promptly erase such personal information from Our records.

If you believe we have inadvertently collected personal information from children under 13 years of age, please contact Us and We will take reasonable actions to promptly erase the personal information from Our records. Please refer to the “How to contact Us” section.

7. Cookies

Like many websites, We may use “cookie” technology to collect additional website usage data and for service improvements, but we do not require cookies for many parts of our Services such as viewing landing page. A cookie is a small data file that is transferred to Your computer’s hard disk or mobile device storage.

We may use cookies to better understand how You interact with our website, to monitor aggregate usage by Our users, and for service improvements. Most Internet browsers automatically accept cookies. If you do not want cookies from Us or other websites, you can instruct your browser, by changing its settings, to stop accepting cookies from the websites you visit. However, some Services may not function properly if you disable cookies.

8. Disclosure and Transfer of Personal Data

Personal data may be disclosed to third parties in accordance with applicable legislation and the practices described in this Privacy Policy.

We may engage and use third parties located in other countries to collect and process personal data on Our behalf and in accordance with Ours instructions. If your personal information is shared by Us with third parties, those third parties are bound by appropriate agreements with Company to secure and protect the confidentiality of your personal information. Company is not liable for the acts and omissions of these third parties, except as provided by mandatory law. If applicable, Your personal information may be processed and stored in other countries and therefore may be subject to disclosure under the laws of those jurisdictions.

Company may disclose your personal data to third parties when We has a reason to believe that a disclosure is necessary to address potential or actual injury or interference with Our rights, property, operations, users or others who may be harmed or may suffer loss or damage, or We believes that such disclosure is necessary to protect Our rights, combat fraud and/or comply with legislation, court order, legal proceedings and process. To the extent permitted by applicable law, We will make reasonable efforts to notify you of such disclosure through Our website or in another reasonable manner.

We may disclose your personal data to third parties in connection with a corporate merger, consolidation, restructuring, the sale of all or a portion of its stock and/or assets or other corporate change, including, without limitation, during the course of any due diligence process provided, however, that this Privacy Policy shall continue to govern such personal information.

9. Data Retention and Correctness

Your personal information will be retained by Us for as long as it is necessary to fulfill the purpose for which it is collected and to meet Our legal and contractual obligations. Please note that some of Your personal information may be retained as long as it is deemed necessary to resolve disputes, enforce user agreements, comply with technical and legal requirements. After which, the aforementioned information will be erased. Company does not verify the correctness of personal information.

If not already done earlier, we will either erase or aggregate Log Data from servers of web content in such manner that anonymizes personal information after 18 months.

10. You May Verify Your Personal Information

You may verify the accuracy of Your personal information that We have on record by submitting a request to Company to access your personal information (Please refer to the “How to contact Us” section below). We will require sufficient information from You to establish your identity. We will respond to your request in a reasonable amount of time, if applicable, in accordance with the legal regulations.

11. Safeguards

We follow generally accepted industry standards and maintain reasonable safeguards to attempt to protect the personal information submitted to Us, both during transmission and once we receive it. No method of transmission, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security.

You may choose to disclose data about yourself in the course of contributing user generated content to the Company.

Any data that you disclose in any of these forums, blogs, chats or the like will become public information, and there is no expectation of privacy or confidentiality.
